Its that time of year again when the fabulous T3 hold their annual gadget awards.

Last year saw HTC take home the glory as the Hero won the award for phone of the year.  Voted in as a wildcard listing, the Hero romped to victory over the likes of the Palm Pre, the Nokia N97 and surprisingly, the Apple iPhone 3GS.

This year HTC will be hoping to repeat that success with not one but TWO handsets in the final 5.  Alongside the Samsung Wave, the BlackBerry Bold 9700 and this year’s wildcard – the iPhone 4, HTC are being represented by the Desire and the Legend.

Will the trend continue from last year with the wild card stealing the show or will the Hero poetically pass the baton to the Legend? Again.

Voting closes September the 16th with the winner to be announced in October, who will you be voting for?

Recently we wrote about Danny Sheena, a Houston attorney who is planning on standing toe-to-toe in a legal throwdown with Apple.  One man acting on behalf of all the Apple customers who have parted with their hard earned cash to purchase the iPhone.  One man taking on an empire in disgust at Apple’s supposed disregard for their customer’s concerns over performance issues.  One man….yeah I know enough of the voiceover monologue already.  In short, Mr Sheena has filed a lawsuit against Apple in the hope that every person who purchased the iPhone 4 will either be re-imbursed or have the handset fixed for free.

It’s possible Mr Sheena would find the Apple document, leaked to Boy Genius Report, of great interest as it lists the procedure AppleCare reps should follow if contacted about the reception issue.  It’s possible that it could be construed to support his claims.  And it goes a little something like this.

1. Keep all of the positioning statements in the BN handy – your tone when delivering this information is important.

a. The iPhone 4’s wireless performance is the best we have ever shipped. Our testing shows that iPhone 4’s overall antenna performance is better than iPhone 3GS.

b. Gripping almost any mobile phone in certain places will reduce its reception. This is true of the iPhone 4, the iPhone 3GS, and many other phones we have tested. It is a fact of life in the wireless world.

c. If you are experiencing this on your iPhone 3GS, avoid covering the bottom-right side with your hand.

d. If you are experiencing this on your iPhone 4, avoid covering the black strip in the lower-left corner of the metal band.

e. The use of a case or Bumper that is made out of rubber or plastic may improve wireless performance by keeping your hand from directly covering these areas.

2. Do not perform warranty service. Use the positioning above for any customer questions or concerns.

3. Don’t forget YOU STILL NEED to probe and troubleshoot. If a customer calls about their reception while the phone is sitting on a table (not being held) it is not the metal band.

4. ONLY escalate if the issue exists when the phone is not held AND you cannot resolve it.

5. We ARE NOT appeasing customers with free bumpers – DON’T promise a free bumper to customers.

So, is this an admission of a problem and an avoidance of correcting it or is it just a company’s directive for an acceptable handset problem?  What do you think?
